Xtreme TV respects copyright and complies with the Digital Millennium Copyright Act, 17 U.S.C. § 512. This page explains how a rights holder submits a takedown notice, how a user answers one with a counter-notification, and what happens to accounts that attract repeated complaints. Valid notices are acted on promptly.

1. Our designated agent

Every DMCA communication must go to the agent below. Notices sent elsewhere may be missed, which delays the outcome for everybody.

2. Sending a takedown notice

If you own copyright in material you believe is reachable through the Service, send our agent a written notice containing all of the following. A notice missing any of it may be treated as incomplete and may not receive a substantive reply.

  1. A physical or electronic signature of the owner, or of somebody authorised to act for them.
  2. Identification of the copyrighted work said to be infringed. Where one notice covers several works, a representative list is acceptable.
  3. Identification of the material complained of, and where it sits, specifically enough for us to find it — URLs are best.
  4. Your name, postal address, telephone number and email address.
  5. A statement that you believe in good faith the use is not authorised by the owner, its agent, or the law.
  6. A statement that the information in the notice is accurate and, under penalty of perjury, that you are the owner or are authorised to act for them.

3. What we do next

On receiving a complete and valid notice we will:

  • review it for completeness and validity;
  • remove or disable access to the material identified, where that is required of us;
  • notify the user responsible, where there is one;
  • pass them a copy of the notice so they can answer it if they believe it is mistaken.

4. Answering a notice

If your material was removed by mistake or misidentification, send our agent a counter-notification containing:

  1. your signature, physical or electronic;
  2. identification of what was removed and where it appeared beforehand;
  3. a statement, under penalty of perjury, that you believe in good faith the removal resulted from a mistake or misidentification;
  4. your name, address and telephone number;
  5. consent to the jurisdiction of the federal district court for the district your address is in, or where we may be found if your address is outside the United States;
  6. agreement to accept service of process from the party who sent the original notice.

We forward a valid counter-notification to the original complainant. If they do not tell us within 10 to 14 business days that they have gone to court to restrain the activity, the material may be restored.

5. Repeat infringers

We terminate, in appropriate circumstances, accounts belonging to users who attract multiple valid takedown notices or who we reasonably conclude are engaged in repeated or wilful infringement. That judgement is ours to make and is exercised in line with applicable law.

6. A caution about false claims

Section 512(f) is not decorative. Anyone who knowingly and materially misrepresents that material is infringing — or that it was removed by mistake — can be made to pay the damages and legal costs of the other side, including those of any service provider that relied on the misrepresentation. We process notices in good faith and expect the same in return; if the position is not obvious to you, take legal advice before filing.

7. Changes to this policy

This policy takes effect on posting and may be updated without notice; changes apply from the moment they appear here.
